The expanded SAVE system is a linchpin in the Trump Administration’s efforts to review and purge state voter rolls for purported noncitizens as it seeks to make it harder for Americans to vote this November.   - [Democratic Party Secures Nationwide Injunction Blocking USPS Rule in its Entirety, a Major Step Forward in Protecting Vote by Mail for the 2026 Midterm Elections](https://elias.law/client-alert/democratic-party-secures-nationwide-injunction-blocking-usps-rule-in-its-entirety-a-major-step-forward-in-protecting-vote-by-mail-for-the-2026-midterm-elections/): Late last night, in DSCC v. Trump, the United States District Court for the District of Columbia issued a nationwide preliminary injunction against the final United States Postal Service (“USPS”) mail in voting rule. This is the first and only court order to block the entirety of the rule, preventing voluntary compliance by Republican states. The order therefore helps stop Republican-led states from working with the federal government to disenfranchise mass numbers of mail voters via USPS before the 2026 election. - [SEC Proposes Rescinding Pay-to-Play Restrictions on Political Contributions by Investment Advisers](https://elias.law/client-alert/sec-proposes-rescinding-pay-to-play-restrictions-on-political-contributions-by-investment-advisers/): Last Thursday, the Securities and Exchange Commission (“SEC”) proposed repealing Rule 206(4)-5 – the so-called “pay-to-play” rule – in its entirety. Since 2010, the rule has barred an investment adviser from receiving compensation for advisory services provided to a government client for two years after the adviser or a “covered associate” contributed to an official or candidate in a position to influence the award of advisory business. It also imposes restrictions on covered associates soliciting funds for such officials, candidates, or political parties. And, in practice, the rule has severely restricted political giving to other organizations, such as PACs and certain nonprofits. The comment period runs for 60 days after publication in the Federal Register. - [4th Circuit Issues Huge Ruling Undermining Republican Strategy This Cycle](https://elias.law/client-alert/4th-circuit-issues-huge-ruling-undermining-republican-strategy-this-cycle/): This afternoon, the U.S. Court of Appeals for the Fourth Circuit held that political party committees and joint fundraising committees are not entitled to the special lowest unit charge discount that the Federal Communications Act provides to federal candidates in the weeks before a federal election. This decision deals a serious blow to the highly publicized plans of the Republican Party to use party committee funds to purchase television ad time for Republican House and Senate candidates at lowest unit charge. As the opinion explains, under federal law, only federal candidates – not party committees or joint fundraising committees with non-candidate members – are entitled to the lowest unit charge discount. This decision therefore helps re-establish the significance of the cash advantage that Democratic candidates have over their Republican counterparts. - [Supreme Court Allows Trump Mail-Voting Executive Order to Proceed](https://elias.law/client-alert/supreme-court-allows-trump-mail-voting-executive-order-to-proceed/): Yesterday, the United States Supreme Court issued an order paving the way for President Trump to implement the parts of his mail-in voting Executive Order that direct the federal government to compile lists of eligible mail voters to send to the states and to prioritize prosecution of election workers who send mail ballots to “ineligible voters.” While this order is undeniably a setback, the fight over implementation of President Trump’s Executive Order is far from over. Indeed, the Court made clear that it was not passing on the merits; instead, it found that lower courts had entered relief too early. There is still time and ample opportunity for the federal courts to block the President’s unprecedented, unconstitutional power grab, and Elias Law Group is in court leading this fight. In the interim, we stand ready to assist clients with on-the-ground programming to combat any impact on voters as the court battles proceed. - [New Senate Guidance Narrows Use of Member Security Funds for Political and Personal Travel](https://elias.law/client-alert/new-senate-guidance-narrows-use-of-member-security-funds-for-political-and-personal-travel/): The Senate Rules Committee and Senate Ethics Committee issued new joint guidance clarifying the permissible uses of appropriated member security funds that are intended for a Member’s safety and well-being. The new guidance affirms that these funds may be used for personal security services, including certain transportation and travel-related expenses for official, campaign, and personal purposes. However, the guidance clarifies that for personal and campaign transportation, the use of member security funds may only be used for the difference between the basic transportation expense and the upgrade for security purposes. Additionally, there must be a contemporaneous written record justifying the use of member security funds for campaign and personal travel. - [SCOTUS Strikes Down Coordinated Party Spending Limits](https://elias.law/client-alert/scotus-strikes-down-coordinated-party-spending-limits/): This morning, the Supreme Court issued its decision in NRSC v. FEC, striking down the limits on how much a political party can spend in coordination with its federal candidates — colloquially known as “coordinated party spending limits” or “441a(d).” Effective immediately, national and state party committees may spend unlimited sums in full coordination with a federal candidate on any campaign expense, including advertising. This decision removes a key pillar of the American campaign finance system and will dramatically re-shape the way funds are raised and spent across the political ecosystem. - [Supreme Court Rejects RNC Attack on Mail Voting](https://elias.law/client-alert/supreme-court-rejects-rnc-attack-on-mail-voting/): Today, in a decisive victory for voters, the U.S. Supreme Court ruled that federal law does not prevent states from counting absentee ballots postmarked by Election Day but received after Election Day. Currently, 14 states, plus the District of Columbia, allow for regular absentee ballots mailed by Election Day but arriving after Election Day to count; many more states allow military and overseas ballots to count in these circumstances. The Supreme Court’s decision, written by Justice Barrett and joined by Justices Jackson, Kagan, Roberts, and Sotomayor, allows these state laws to stand. - [Supreme Court Issues Devastating Opinion in Louisiana v. Callais](https://elias.law/client-alert/supreme-court-issues-devastating-opinion-in-louisiana-v-callais/): This morning in Louisiana v. Callais, the U.S. Supreme Court gutted the Voting Rights Act, holding that states are free to draw congressional maps that seek political gain for the party in power, even if doing so comes at the expense of Black, Hispanic, or other minority voters. - [President Trump Signs Unlawful Executive Order Attacking Mail-In Voting](https://elias.law/client-alert/president-trump-signs-unlawful-executive-order-attacking-mail-in-voting/): This evening, President Trump signed an Executive Order (the “Order”) to create a master list of U.S citizens eligible to vote in federal elections and force states to limit access to mail ballots to individuals on that list. The Order, titled “Ensuring Citizenship Verification and Integrity in Federal Elections,” represents a dramatic escalation of the President’s efforts to perpetuate his false claims of widespread non-citizen voting and significantly threatens the orderly administration of upcoming primary and general elections. - [Supreme Court Hears Oral Argument in Key Voting Case](https://elias.law/client-alert/supreme-court-hears-oral-argument-in-key-voting-case/): Today, the Supreme Court heard oral arguments in Watson v. RNC, a case that could have major implications for the 2026 elections. RNC, the Mississippi Republican Party, and individual voters challenged Mississippi’s ballot receipt deadline in January 2024. Under Mississippi law, a voter’s mail-in ballot is counted if it is postmarked on or before Election Day and arrives within five business days of the election. The Republicans have alleged that this deadline extends the federal election past Election Day in violation of federal law. A ruling in the Republicans’ favor could impact the votes of millions of Americans who vote by mail across the country, as well as military and overseas voters around the world. - [New FCC Guidance Signals Intent to Target Talk Shows, TV Stations over Candidate Appearances](https://elias.law/client-alert/new-fcc-guidance-signals-intent-to-target-talk-shows-tv-stations-over-candidate-appearances/): The Federal Communications Commission (“FCC”) issued guidance signaling its intent to change its interpretation of the “equal opportunities” (or “equal time”) rules for candidate appearances on TV. FCC Chairman Brendan Carr said the new guidance “reminded” TV networks that late night and daytime talk shows that are “motivated by purely partisan political purposes” will require TV stations to provide “equal opportunities” to all candidates. - [U.S. Supreme Court Hears Oral Argument in Historic Case Seeking to Strike Down Coordinated Party Spending Limits](https://elias.law/client-alert/u-s-supreme-court-hears-oral-argument-in-historic-case-seeking-to-strike-down-coordinated-party-spending-limits/): This morning the United States Supreme Court heard oral argument in NRSC v. FEC, a case seeking to strike down the limits on how much a political party can spend in coordination with its federal candidates. If the Court rules in favor of the Republicans, it will have two enormous effects. First, it will mean that there is no limit on the amount that a political party committee can spend on behalf of a federal candidate in the form of in-kind contributions. In other words, a party committee would be free to spend as much money as it wanted (raised under much higher contribution limits) to pay for a campaign's own expenses, including advertising in full coordination with the campaign. Second, it will fundamentally reshape the Supreme Court’s campaign finance jurisprudence in a way that raises serious questions regarding the constitutionality of a number of other campaign finance restrictions. A decision is expected by the first week of July. More background on this critical case is below; for specific questions we encourage clients to reach out to Elias Law Group attorneys.    - [Court Finds 501(c)(4) Exemption & Political Activity Standard Unconstitutional](https://elias.law/client-alert/court-finds-501c4-exemption-political-activity-standard-unconstitutional/): Yesterday, the United States District Court for the District of Columbia issued a notable Memorandum Opinion and Order in Freedom Path, Inc. v. The purported goal of the Memo is to crack down on illegal “straw donor” and foreign contributions in American elections. In reality, the Memo represents a political attack against a prominent Democratic fundraising platform. The Memo and accompanying fact sheet focus significant attention on ActBlue and do not mention any other platform by name. - [FEC Issues Guidance on LLC Contributions](https://elias.law/client-alert/fec-issues-guidance-on-llc-contributions/): The Federal Election Commission (“FEC”) recently issued guidance clarifying the Commission’s approach for enforcement matters involving reporting LLC contributions. All federal candidates and political committees should familiarize themselves with the Commission’s new guidance, including its newly approved sample donor LLC letter. - [New Executive Order Attempts to Overhaul Federal Elections](https://elias.law/client-alert/new-executive-order-attempts-to-overhaul-federal-elections/): Yesterday, President Trump issued a sweeping executive order (the “Order”) attempting to overhaul federal elections by making it harder to register to vote, threatening to withhold federal funding from states that count mail ballots received after Election Day, ordering a myriad of programs aimed at verifying the citizenship status and eligibility of voters, and making it more difficult for uniformed and overseas voters to cast a ballot. Additional details about the Order are below. - [EEOC and DOJ Publish Anti-DEI Guidance, Suggest DEI Programs May Violate Title VII of the Civil Rights Act](https://elias.law/client-alert/eeoc-and-doj-publish-anti-dei-guidance-suggest-dei-programs-may-violate-title-vii-of-the-civil-rights-act/): On March 19, 2025, the U.S. Equal Employment Opportunity Commission (“EEOC”) and Department of Justice (“DOJ”) issued two new technical assistance documents addressing Diversity, Equity, and Inclusion (“DEI”) actions and programs in the workplace (collectively, the “guidance”). The guidance characterizes various kinds of DEI-related initiatives as potential violations of Title VII of the Civil Rights Act of 1964 (“Title VII”) and is framed as advice to employees who may have experienced “DEI-related discrimination” in the workplace. - [Updated Personal Use Guidance from House of Representatives Committee on Ethics](https://elias.law/client-alert/updated-personal-use-guidance-from-house-of-representatives-committee-on-ethics/): House Rule 23, clause 6(b) - [Trump’s Anti-DEI Executive Order and its Potential Impact on Nonprofit Organizations](https://elias.law/client-alert/trumps-anti-dei-executive-order-and-its-potential-impact-on-nonprofit-organizations/): This week, President Trump signed a politically charged executive order to end “diversity, equity, inclusion, and accessibility” (“DEIA”) and “diversity, equity, and inclusion (“DEI”) programming in the government and private sector, including nonprofits. The order, “Ending Illegal Discrimination and Restoring Merit-Base Opportunity” (“Order”) declares it the policy of the United States that DEI programs are illegal and incompatible with civil rights law. - [New Development on Section 501(c)(4) Exemption Standard](https://elias.law/client-alert/new-development-on-section-501c4-exemption-standard/): On October 28, the U.S. Court of Appeals for the Fifth Circuit issued an opinion in the case Memorial Hermann ACO v. Commissioner. The decision fundamentally uproots a longstanding interpretation regarding the amount of nonexempt activities 501(c)(4) organizations may engage in without jeopardizing their 501(c)(4)status. We recommend that 501(c)(4) organizations review this alert to become familiar with the decision, assess their individual risk, and consult with counsel on how to proceed. - [FEC allows limited use of campaign funds for candidate and officeholder security](https://elias.law/client-alert/fec-allows-limited-use-of-campaign-funds-for-candidate-and-officeholder-security/): Key Takeaway: Last week, the Federal Election Commission (“FEC”) approved a regulation clarifying that campaign funds may be used to pay for security measures without violating the prohibition on using campaign funds for personal use. - [FEC Confirms Federal Candidates and Officeholders May Solicit Unlimited Contributions for State Ballot Initiatives](https://elias.law/client-alert/fec-confirms-federal-candidates-and-officeholders-may-solicit-unlimited-contributions-for-state-ballot-initiatives/): Key Takeaway: Last week, the Federal Election Commission (“FEC”) approved a request by Elias Law Group that authorizes federal candidates and officeholders to solicit unlimited contributions from individuals, corporations, and labor unions, among others, for state ballot initiatives. - [Federal Election Commission Issues Advisory Opinion Regarding Paid Canvassing](https://elias.law/client-alert/federal-election-commission-issues-advisory-opinion-regarding-paid-canvassing/): Last week, the Federal Election Commission (“FEC”) issued an important advisory opinion regarding paid canvassing programs that advocate for federal candidates. Texas Majority PAC, a state PAC represented by the Elias Law Group, told the FEC that it would consult with federal candidates, party committees, and their agents on its paid canvassing program, and asked whether doing so would transform its paid canvassing communications into “coordinated communications” or “coordinated expenditures” (thereby making them excessive in-kind contributions). As a Texas state PAC, Texas Majority PAC raises unlimited non-corporate, non-labor treasury funds. The FEC confirmed that such paid canvassing communications are not “coordinated communications” or “coordinated expenditures” and therefore are not in-kind contributions to the federal candidate or party committee. - [The FCC Did Not Ban All AI Robocalls](https://elias.law/client-alert/the-fcc-did-not-ban-all-ai-robocalls/): The FCC Did Not Ban All AI Robocalls - [FEC Confirms Separate Contribution Limits for Nonfederal PACs Established by Federal Candidates or Officeholders](https://elias.law/client-alert/fec-confirms-separate-contribution-limits-for-nonfederal-pacs-established-by-federal-candidates-or-officeholders/): Key Takeaway: Last week, the Federal Election Commission (“FEC”) approved a request from the Elias Law Group to allow federal candidates and officeholders to raise funds into state PACs under a separate contribution limit from funds raised into their federal leadership PACs, provided the state PAC does not engage in federal election activity. In raising funds, the state PAC must still comply with the federal source restrictions and contribution limits under the Federal Election Campaign Act, as amended (“FECA”).  - [Michigan Introduces Disclaimer Requirements on Political Ads Using AI](https://elias.law/client-alert/michigan-introduces-disclaimer-requirements-on-political-ads-using-ai/): Michigan Governor Gretchen Whitmer recently signed into law several bills regulating the use of artificial intelligence in political advertisements in the state. The new laws require the use of disclaimers to inform the public if ads employ artificial intelligence (“AI”). Although several states have taken steps to regulate so-called political “deepfakes,” Michigan is the first state to more broadly regulate the use of AI technology in political advertisements, regardless of whether the use of AI has the potential to mislead the public. - [Federal Election Commission Adopts New Rules on Candidate Compensation](https://elias.law/client-alert/federal-election-commission-adopts-new-rules-on-candidate-compensation/): On December 14, 2023, the Federal Election Commission voted 5-1 to revise its personal use rules on the use of campaign funds to pay candidate salaries to “‘compensate candidates for lost income that is forgone due to becoming a candidate.’” FEC Agenda Document No. 23-30-A at 13 (citing 2002 Final Rule, 67 FR at 76962). The final rules will be published in the Federal Register and become effective at a future specified date. The Commission significantly changed the criteria for determining whether a candidate is eligible to receive compensation, the maximum amount of compensation that a candidate may receive, and the period during which a candidate may receive compensation.  - [Receiving Email Addresses for Free May Break the Law, According to Federal Court Decision](https://elias.law/client-alert/receiving-email-addresses-for-free-may-break-the-law-according-to-federal-court-decision/): Last week, the federal district court in Washington, D.C. issued a decision in Ready for Ron v. FEC, No. 1:22-cv-03282 (RDM) (D.D.C. filed Oct. 27, 2022), involving Ready for Ron (“RFR”), a hybrid political committee that wanted to give Governor Ron DeSantis a signed petition containing email addresses and phone numbers of individuals encouraging him to run for president. In its 60-page decision, the court concluded that the petition was a “contact list” and therefore a “thing of value” that, if accepted by DeSantis, would necessarily mean that he was either a candidate for president or testing the waters, both of which require that contributions comply with federal campaign finance laws. Because RFR created the list using, in part, money not subject to the source restrictions and contribution limits (“soft money”) and the value of the list was in excess of the contribution limits from a PAC to a candidate, the proposed arrangement is an excessive and impermissible in-kind contribution. - [House and Senate Now Accepting CY 2022 Personal Financial Disclosure Statements](https://elias.law/client-alert/house-and-senate-now-accepting-cy-2022-personal-financial-disclosure-statements/): The House and Senate have opened their electronic filing systems and are now accepting personal financial disclosure statements (“FD Statements”) for Calendar Year 2022. Each year, filers must submit their FD Statement by May 15 unless they request an extension. Additional details on who must file, what information must be reported, and the deadlines to file are below. - [FEC Updates Contribution Limits for 2023-2024 Election Cycle](https://elias.law/client-alert/fec-updates-contribution-limits-for-2023-2024-election-cycle/): Today, the Federal Election Commission (“FEC”) raised the contribution limits for the 2023-2024 election cycle for individuals and non-multicandidate political action committees (“PACs”) contributing to federal candidates and national party committees. The FEC also raised the contribution limit shared by a national party committee and its Senatorial campaign committee contributing to Senate candidates. - [IRS Requires Qualified Appraisal to Deduct Crypto Donations](https://elias.law/client-alert/irs-requires-qualified-appraisal-to-deduct-crypto-donations/): On January 10, the Internal Revenue Service issued guidance that requires taxpayers who make charitable contributions of cryptocurrency to receive a qualified appraisal to qualify for a charitable deduction.1 Taxpayers may not determine the value of the donated cryptocurrency based on the value reported by a cryptocurrency exchange on which the cryptocurrency is traded. Significantly, if taxpayers fail to obtain a qualified appraisal before their taxes are due, they will not be able to deduct the contribution. - [House Republicans Adopt Ethics Changes](https://elias.law/client-alert/house-republicans-adopt-ethics-changes/): Yesterday, House Republicans adopted new rules for the House of Representatives for the 118th Congress. The rules package changes several important ethics-related provisions, including allowing members of the public to submit complaints to the Committee on Ethics and important changes related to Board appointments and staffing for the Office of Congressional Ethics. In a separate redistricting case involving state legislative districts decided last month, the Supreme Court of Wisconsin expressly overruled the requirement it imposed in 2021 that judicially adopted maps must make the “least changes” possible to the prior decade’s configuration. Although proponents claimed that the new law was simply meant to prohibit double voting, it goes much further than that, putting voters who have previously registered in other jurisdictions at risk of criminal penalties, even if they have no intention of voting in more than one place and never actually violate Montana’s double voting prohibition. By pairing vague new voter registration requirements with draconian criminal penalties, HB892 threatens entirely lawful, qualified voters with severe fines and imprisonment, chills the exercise of Montanans’ basic political rights, and is likely to lead to arbitrary enforcement. - [Florida Judge Strikes Down DeSantis Congressional Map](https://elias.law/press-release/florida-judge-strikes-down-desantis-congressional-map/): WASHINGTON – On September 2, a state trial court judge in Florida struck down the state’s congressional map, finding that the redistricting plan championed by Gov. Lee Marsh dismantled the previous configuration of Florida’s 5th Congressional District, illegally diminishing the ability of Black voters in North Florida to elect their candidate of choice. - [Federal Court Rejects Alabama’s Latest Congressional Map, Initiates Remedial Redistricting Process](https://elias.law/press-release/federal-court-rejects-alabamas-latest-congressional-map-initiates-remedial-redistricting-process/): WASHINGTON – Today, a panel of three federal judges struck down Alabama’s new congressional redistricting map, finding that the map did not comply with the U.S. Supreme Court’s recent ruling in Allen v. Milligan, which held that Alabama’s congressional map must include two districts that allow Black voters to elect their candidate of choice.
